Overloaded Trucks

The Federal Highway Administration sets a maximum weight of 80,000 pounds (40 tons) for an 18-wheeler. Federal, state and local laws also dictate maximum loads for other types of trucks or on certain roads. Overloaded trucks are subject to large fines — if they are caught. Some commercial haulers take the risk because more cargo means more profit.

An overweight truck requires more distance to stop and decreases maneuverability. Truckers often fail to take this into account, especially at stoplights and freeway exit ramps. An overloaded truck also puts more stress on tires and brakes, which may fail if the truck has to swerve or stop suddenly.

Unsafe or Unbalanced Loads

Shifting freight or poorly secured freight can cause trucks to jackknife, overturn, or veer into other lanes of traffic, or from cargo or tarps that fall off the truck. The trucking company is responsible for loading errors or failure to tie down freight. The driver is also responsible for pre-trip inspections.

A trucking company or driver that knowingly exceeds weight restrictions or carelessly loads the trailer is playing roulette with other people's lives. Lorenz & Lorenz, L.L.P. knows what to look for in an 18-wheeler wreck.
