Austin Truck Driver Fatigue Attorneys

Too Many Hours Behind the Wheel

Truck driver fatigue is a factor in many truck accidents. Recognizing the danger to other motorists, federal regulations strictly limit how many hours a trucker can be on the road in a day. But these rules are routinely ignored, with disastrous results.

Lorenz & Lorenz, L.L.P. has extensive experience in the investigation of 18-wheeler accidents in pursuit of compensation. We have recovered damages for a number of truck crash victims by demonstrating how driver fatigue and other negligence led to the crash.

Austin accident attorney Ted Lorenz and his team have handled thousands of motor vehicle cases in Travis County, Williamson County, Harris County and surrounding areas of central Texas, with demonstrated results in truck accidents. Call 877-LORENZ2 (877-567-3692) for a free consultation.

Truck Driver Fatigue as a Cause of Tractor-Trailer Accidents

The Federal Motor Carrier Safety Administration (FMCSA) has stringent rules for over-the-road truckers and other professional drivers. The FMCSA limits the number of hours that drivers can be at the wheel in a day, and dictates minimum hours of rest between shifts. It also sets a maximum number of hours per week.

But truckers and trucking companies make more money by making more deliveries. So there is pressure to stay on the road longer (and exceed speed limits if necessary) to deliver on time and "keep on trucking." Commonly, the logbooks are fudged to satisfy the FMCSA.

Lorenz & Lorenz is savvy to these practices. It's one of the first things we look at. If liability is disputed, we obtain the driver's logbooks and compare them against actual departures, deliveries, weigh station times or truck stop receipts. "Black box" data recorders and GPS transponders also may prove the violations.

A driver who has not had scheduled sleep or is drowsy from exceeding allowable hours is more likely to nod off and drift into the next lane, cross over the centerline or rear-end another vehicle. Studies have shown that truck driver fatigue also affects judgment and reaction times.
