What You Say Can Hurt You

The Don'ts

  • Do not admit fault — to the other driver, to police, or to an insurance agent. It could bar or limit your recovery of damages.
  • Don't give any statement before you talk to an attorney. You might say something to hurt your case without even realizing it.
  • Do not handle your own claim. In our experience, you are more likely to mess up your claim beyond repair than to come out ahead by negotiating directly with a big insurance company.
  • Don't sign anything, especially a settlement offer!
  • Do not tell an insurance representative that you feel "fine" or "better."
  • Don't assume your case is too small. We welcome soft tissue injury claims and other supposedly "minor" injuries — which often turn out to be more serious.
  • Don't delay medical treatment. You could make your injury worse if what you believe to be merely soreness is actually a fracture, a torn ligament or other tissue damage. Insurers are also skeptical of people who weren't injured badly enough to see a doctor after the accident.

The Do List

  • Report your accident within a timely period to your insurance carrier (after consulting a doctor and a lawyer). We can advise you on what to say or deal with the insurer on your behalf.
  • Take charge of your medical care. Tell your doctor about all injuries or symptoms, and how your injuries limit your movement or affect daily life. Ask questions. Ask for a referral to a specialist or get a second opinion if you disagree with the diagnosis or treatment.
  • Follow up with treatment and document your recovery. Report any new or worsening symptoms to your doctor and to your attorney.
