What if the Other Driver's Coverage Falls Short?

Every insurance policy has limits. It is very common in car accidents that the driver who caused the crash does not have enough coverage to pay for all the damage.

If you are the injured party, you are not stuck with the difference. Part of your own insurance premium goes for Uninsured Motorist and Underinsured Motorist coverage, or UM/UIM. Your insurer is obligated to cover your losses if the negligent party can't.

Uninsured Motorist

All drivers in Texas are required to carry liability insurance for bodily injury to others. In fact, Texas has one of the highest standards for minimum liability coverage: $25,000 per person, up to a total of $50,000 for all people injured in a single accident.

Your UM/UIM policy is supposed to kick in if:

  • The other driver does not have any auto insurance
  • You were injured in a hit-and-run and the driver's identity is not known

Underinsured Motorist

Most drivers carry only the minimum liability coverage. This is a problem if:

  • Your injuries exceed the $25,000 limit
  • Several people were hurt and the combined losses exceed $50,000

A serious injury can go through $25,000 quickly: hospitalization, surgery, rehab, lost wages, compensation for pain and suffering, plus any disfigurement, disability or reduced earning capacity. Additional losses not covered by the at-fault driver should be covered under your UM/UIM policy.

It's Never That Simple

Insurance companies will fight UM/UIM claims: They may claim your injury isn't related to your car wreck. Your treatment isn't necessary. Your provider charges too much. You didn't pay your premium. And so on.
