Authorities say driver fled scene of fatal Manor car accident

Authorities are saying that a driver fled the scene of a fatal car accident in Travis County. The accident, which occurred just over a week ago, involved the collision of two cars heading east on U.S. 290 near Old Kimbro Road. While the driver of one vehicle fled, one of the five occupants of the other vehicle died at the scene. The other four -- including an infant -- were treated at area hospitals.

The investigation into the cause of the accident continues, but police have stated that it took place at a dangerous intersection. In addition to the potential for seeking compensation in cases involving negligent driving, those who have been injured in an accident may be able to receive compensation from a municipality, county or the state of Texas due to unsafe road conditions such as a dangerous intersection.

A history of collisions at an intersection may be used as evidence of poor or outdated highway design. Other road issues that can be considered evidence include: potholes and other maintenance issues, lack of proper signage, lack of proper drainage, lack of guardrails on curves along steep embankments, and insufficient barriers between opposing lanes.

Highway standards are uniform and easily accessible for all civil engineers and road construction contractors. While the federal, state and even local governments have created statutes pertaining to the safety of the roadway, sometimes they fail to keep up with the needs of 21st century travelers. In those times, they can be held accountable for injuries and wrongful death, just as a driver can be held accountable for unsafe driving practices such as drinking and driving, texting while driving, or other negligent practices.
