Cyclist in Texas killed in auto-versus-bicycle accident

Drivers and cyclists alike need to be aware of each other when out on the road. While cyclists are required to follow road rules, many drivers still fail to see them or yield to their right of way. Cyclists struck by a vehicle often end up with severe injury and quite a few succumb to those injuries. A recent case to find its way to the Texas court system, involves two men being charged with the death of a man in a vehicle versus bicycle accident, which occurred earlier this month.

In the early morning hours, a 38-year-old male was out on his bike on a local street in Edinburg. He was apparently struck by a pickup truck near an intersection and died at the scene. To make matters worse, the driver of the truck and his passenger are accused of trying to dispose of the body. They were arrested by local authorities while in the process of moving the victim's body.

The driver is facing charges including intoxicated manslaughter, tampering with evidence, failure to report a crime and DUI. He remains in custody in lieu of bond, which was set at $2.25 million. His passenger is also being charged for failing to report the crime and also remains in jail, with bond set at $500,000.

This situation is certainly tragic and heart-wrenching for the victim's family members. Thankfully, those deemed responsible for this fatal bicycle accident have been caught and are facing criminal charges for their actions. Aside from the criminal charges, a wrongful death claim may be filed against both of these individuals. If either or both men are found liable for the victim's death, a civil court in Texas could grant the victim's surviving family members monetary compensation for their loss.
