The loss of a loved one, regardless of how or when it happens, is never easy. However, when the loss is the sudden and unexpected result of a fatal accident, surviving family members may have a harder time trying to cope. Recently, a family in Texas has had their whole world turned upside down due to possible negligence of another driver.
A father and three children were heading northbound through a local intersection in Caldwell when their vehicle was struck by a FedEx van. The driver of the van had supposedly run through a flashing red light just before colliding with the victim's vehicle. The father and his two young sons were killed in the crash. A 2-year-old girl, strapped into a safety seat at the time of the accident, survived and was transported to a local children's hospital for treatment.
The driver of the FedEx van was also taken to a medical facility for treatment and is reportedly in good condition. The accident shut down the intersection to northbound traffic for approximately five hours while local authorities investigated the scene. It is unknown if any criminal charges will be filed against the FedEx driver.
While the surviving family members are left grieving their loss, they are also being faced with the financial hardship of trying to find funds to cover the unexpected expenses that have resulted from the incident. In an effort to recoup the financial losses they have endured as a result of this fatal accident including funeral expenses, medical expenses and future loss of earnings, the surviving family members may be entitled to pursue wrongful death claims and a personal injury claim against both the driver and his employer. If negligence is found to have been a contributing factor in the crash and liability is affirmed, a Texas civil court could award financial compensation for the loss of life and injuries suffered.
